Workshop Notices for Insurers

In an effort to increase public participation and improve the quality of potential regulations, Government Code section 11346.45 permits an agency to hold prenotice public discussions about proposed concepts which may ultimately evolve into a formal rulemaking proceeding. Similarly, the Department of Insurance periodically holds prenotice public discussions about proposed rules which, pursuant to Government Code section 11340.9, are exempt from the Administrative Procedure Act. These prenotice public discussions, more commonly known as “workshops,” are an opportunity for the public to engage in a more informal dialogue with the agency about various topics relating to a particular rulemaking concept, such as the need for the potential rule, the proposed scope for the theoretical rule, and the laws which relate to the development of the potential rule.
